Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Amoga platform and related services provided by Amoga Technologies (“Amoga”). Please read them carefully.
1. Acceptance of Terms
By accessing or using the Amoga platform and services, you agree to be bound by these Terms of Service and our Privacy Policy. If you are using Amoga on behalf of an organization, you represent that you have authority to bind that organization.
2. Use of Services
You may use Amoga services only for lawful purposes and in accordance with these Terms. You agree not to use the services to violate any applicable law, infringe intellectual property rights, transmit harmful content, or interfere with the security of the platform.
3. Your Data
You retain all ownership rights to the data you input into Amoga. We process your data only as directed and as described in our Privacy Policy. Upon termination, you may export all your data. We do not claim any intellectual property rights over your data.
4. Intellectual Property
The Amoga platform, including its software, design, and documentation, is owned by Amoga Technologies and protected by intellectual property laws. Applications you build using the platform are your property.
5. Subscription and Payment
Subscription fees are as agreed in your order form. Fees are non-refundable unless required by law. We reserve the right to suspend services for non-payment after providing reasonable notice.
6. Availability and Support
We aim to provide platform availability per the SLA in your order form. Planned maintenance will be communicated in advance. Support is provided per the support tier included in your subscription.
7. Limitation of Liability
To the maximum extent permitted by law, Amoga's total liability is limited to the fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.
8. Termination
Either party may terminate the agreement with the notice period specified in your order form. Upon termination, your access will be suspended and data will be retained for 90 days for export before deletion.
9. Governing Law
These Terms are governed by the laws of the jurisdiction specified in your order form. Any disputes will be resolved through binding arbitration, except where prohibited by local law.
10. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated with at least 30 days' notice. Continued use of the services after the effective date constitutes acceptance.
